Recent Cases

Mark Thompson vs. Quorum Health Resources, Inc. (Sixth Circuit Court of Appeals) Affirming $1,370,714.72 judgment in U.S. District Court in the Western District of Kentucky. The Caudill Law Office prevailed in a one week trial in which the jury found that Quorum unlawfully retaliated against Thompson (former CEO of the Monroe County Medical Center) by firing him for filing a qui tam lawsuit under the federal false claims act.

Donald Braden, et al v. Endeavor Energy Resources (Breckinridge Circuit Court). The Plaintiffs, represented by the Caudill Law Office, won a judgment of $73,000.00 against Endeavor (one of the ten largest oil and gas companies in Texas) on claim of conversion of natural gas from the Braden’s property, which occurred in 2005.

United States of America vs. Edward Morris (United States District Court for the Western District of Kentucky-Louisville). Morris, a former president of the Outlaw Motorcycle Gang, was convicted of being a felon in possession of a firearm. Morris was witnessed along with other club members firing a handgun in the air during the funeral of a fellow gang member (which is customary tribute during the funeral of a member of the motorcycle club) by an undercover ATF agent posing as a member of the gang. U.S. District Judge John G. Heyburn sentenced Morris to probation over the objection of the United States based on a motion filed by the Caudill Law Office to depart downward from a sentencing range of 18-24 months arguing that Morris was the only caregiver for his elderly and sick mother.

United States v. Harris (United States District Court for the Western District of Kentucky-Bowling Green). Harris sentenced to 30 days in jail to be served on weekends to allow him to work. Harris was convicted of misappropriation of over $100,000.00 in a bank fraud scheme. Judge Joey McKinley granted motion of Caudill Law Office over the objection of the United States to depart downward from a guideline sentence of 28 months based on Harris sincere remorse and total repayment of restitution to the victim, aberrant behavior and his history of charitable works in the community.

United States v. Igleheart (United States District Court for the Western District of Kentucky-Owensboro). Igleheart was convicted of falsifying a bank loan application which resulted in a $1.3 million dollar loss to victim bank. Although Igleheart was originally facing a potential guideline sentence of 48 months, the Caudill Law Office successfully moved the court to depart downward to a sentence of 21 months to be served in a federal prison camp because defendant’s guideline range overstated the seriousness of his offense. Igleheart served approximately 18 months of sentence before his release.
